1. Overview and scope of application
This Privacy Policy is an integral part of the IRIS tool (“Platform”) Terms of Use (“Agreement”), and is incorporated therein by reference for access and use of the Platform. Capitalized terms not defined in this Privacy Policy shall have the meaning ascribed to them in the Agreement. This Privacy Policy shall be read in conjunction with the Agreement. In the event of a conflict between the terms and conditions of the Privacy Policy and those contained in the Agreement, the terms of the Agreement shall control, supersede and prevail.
This Privacy Policy applies to processing of personal data that is collected in any jurisdiction including India by use of or accessing the Platform, which means information about an identifiable individual (“You” or “Your”), that Tech Mahindra Limited, its affiliates and subsidiaries (“TechM”, “We”, “Our” or “Us”) collect through the Platform about any user of the Platform. It also describes Your data protection rights, including Your right to object to some of the processing that We may carry out. More information about Your rights, and how to exercise them, is set out in the Your Choices and Rights section below.
2. What Personal Data (as defined below) We may collect:
a. Personal Identification and communication information: Your name, email address and password to access the IRIS tool.
b. Personal Identification and communication information and application related information are hereinafter collectively referred to as “Personal Data”.
3. Why We collect, Use and Store the Personal Data:
a. Collection of Personal Data for propagating business
From time to time, We may request aforementioned Personal Data from You to process Your ideas through Our Platform, and to get valuable feedback from Your experience on Our Platform. In addition, We may also use Your Personal Data for other business purposes or in order to help serve You better, such as informing You of new services, or alliances that could help You. Your posting of any such Personal Data is strictly up to You. While You can visit Our Platform without disclosing any Personal Data, however, to apply or to register on Our Platform there are web pages that require such information to complete certain functions, thus these web pages may not be available to You, if You decide not to reveal the information requested. We will take reasonable steps to ensure that Your Personal Data is accurate and complete.
b. Third parties across the globe may access Your Personal Data to verify Your details through the Platform. Due to design of Platform as per business reasons, Your Personal Data are published openly on the Platform.
c. Collecting Personal Data for on-line surveys
At times, We conduct online surveys to better understand the needs and profile of Our visitors. When We conduct a survey, We will inform You about how We will use the Personal Data prior to Your taking the survey. If You do not want to participate in the survey, You may refrain from contributing to it at Your own discretion.
d. Collecting domain information
Our Platform may use a technology known as web beacons - sometimes called single-pixel gifs - that allow this Platform to collect web log information. A web beacon is a graphic on a web page or in an email message designed to track pages viewed or messages opened. Web log information is gathered when You visit one of Our Platform by the computer that hosts Our Platform (called a “webserver”). The webserver automatically recognizes some information, such as the date and time You visited Our Platform, the pages You visited, the website You came from (to the extent You have given Your consent), the type of browser You are using (e.g., Internet Explorer), the type of operating system You are using (e.g., Windows 10), and the domain name and address of Your Internet service provider. If You have given Your consent, We may also include web beacons in promotional email messages in order to determine whether messages have been opened.
e. Use of cookies
To the extent You have given Your consent, Our Platform uses a technology called a “cookie”. A cookie is a piece of information that Our webserver sends to Your computer (actually to Your browser file) when You access a website. Then when You come back Our Platform will detect whether You have one of Our cookies on Your computer. Our cookies help provide additional functionality to the Platform and help Us analyze Platform usage more accurately. For instance, Our Platform may set a cookie on Your browser that keeps You from needing to remember and then enter a password more than once during a visit to the Platform.
f. IP address
Our Platform uses Internet Protocol (IP) Addresses. An IP Address is a number assigned to Your computer by Your Internet service provider so You can access the Internet. Generally, an IP address changes each time You connect to the Internet (it is a “dynamic” address). We use Your IP address to report aggregate information on use and to help improve the Platform.
You should be aware that this Platform is not intended for, or designed to attract, individuals under the age of 18. We do not collect personally identifiable information from any person We actually know is an individual under the age of 18.
Areas of this Platform that collect Your Personal Data use industry standard secure socket layer encryption (SSL); however, to take advantage of this Your browser must support encryption protection (found in Google Chrome, Internet Explorer release 3.0 and above).
4. Where We store the Personal Data
The Personal Data You provide to Us via Our Platform is transferred to and stored on Our in-house secure database and is processed to support Your enquiry to become a User on the Platform. Our Platform and database are both hosted within India . The Personal Data, however, may be maintained or processed by staff operating outside India who work for one of Our suppliers
A transfer of Your Personal Data may happen if any of Our servers are located in a country outside of India or one of Our service providers is located in a country outside of India. If We transfer or store the Personal Data outside India in this way, We will take steps with the aim of ensuring that Your privacy rights continue to be protected, as outlined in this Privacy Policy and in accordance with applicable data protection laws. ). If You use the Platform while You are outside of India, Your Personal Data may be transferred outside India in order to provide You with these services.
5. Processing purposes
We collect the data to ensure a proper connection buildup and system security, and to improve Our Platform. We have a legitimate interest in the provision of Our Platform and services, in technical security, rectification of malfunctions as well as detection and tracking of unauthorized access or attempt of access.
6. Disclosure to third parties
To the extent permitted by law and to fulfill the purpose of this Platform, We may share Your Personal Data with agents, contractors or partners of the TechM in connection with services that these individuals or entities perform for, or with, TechM, which shall ensure the same degree of data protection policies and procedures as stated in this Privacy Policy. These agents, contractors or partners are restricted from using this Personal Data in any way other than to provide services for TechM, or services for the collaboration in which they and TechM are engaged. We may, for example, provide Your Personal Data to agents, contractors or partners for hosting TechM databases, for data processing services, or so that they can mail You information that You requested. You may remove Yourself from any such list or notification at any time.
We reserve the right to share Your Personal Data to respond to duly authorized information requests of governmental authorities or where required by law. In exceptionally rare circumstances where national, state, or company security is at issue, We reserve the right to share Our entire database of visitors and customers with appropriate governmental authorities.
We may also be required to disclose Your Personal Data in the event of a legal investigation or any such other process where We are required to do so by applicable law or where We have to establish Our legal rights or where disclosure is required to prevent or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person.
To the extent permitted by law, We may also provide Your Personal Data to a third party in connection with the sale, assignment, or other transfer of the business of this Platform to which the information relates, in which case We will require any such buyer to agree to treat Your Personal Data in accordance with this Privacy Policy.
As a convenience to Our visitors, this Platform may contain links to a number of sites that We believe may offer useful information. The policies and procedures We described here may not apply to those sites. We suggest contacting those sites directly for information on their privacy, security, data collection, and distribution policies.
We will process, disclose or share Your Personal Data only if required to do so by law or in good faith belief that such action is necessary to comply with Our contractual obligations, legal requirements or legal process served on Us or requirement of the Platform.
7. Verification of Data:
To the extent permitted by law, it will be necessary for Us to verify the details You have supplied (e.g. Your identity, employment history, academic qualification and professional credentials). Such verification could be done through third party service providers, who shall be bound the obligation of confidentiality and data protection.
8. Monitoring:
Where permitted by applicable law, We reserve the right to monitor, intercept, access and erase all information, material, data and communication (including emails, telephones conversations, and voicemail recording, regarding registration and further processing of Your application through the Platform.
9. How We share Your Personal Data:
We will share Your Personal Data with other TechM group entities or third party companies or Customers or Service Providers, to the extent required for the work or work opportunity, You are applying for or assignments.
In the event that a TechM business is sold or integrate with another business in total or in part, Your details may be disclosed to Our advisers, and prospective purchaser’s advisers, and will be passed to the new owners of the business.
10. Your Choices and Rights:
You have the right to ask Us for copy of Your Personal Data; to correct, delete, or restrict processing of Your Personal Data; and to obtain the Personal Data You provide in a structured and machine readable format. In addition, You can object to the processing of Personal Data, in some circumstances (in particular, where We do not have to process the data to meet a contractual or legal requirement). Where We have asked for Your consent, You may withdraw consent at any time. If You asked to withdraw Your consent, to Us processing Your data, this will not affect any processing which has already taken place at that time. In this case it will be irisadmin@techmahindra.com
These rights may be limited, for example, if fulfilling Your request would reveal personal data of another person, or if You ask Us to delete information which We are required by law or have compelling legitimate interests to keep. If You have unresolved concerns, You have the right to complain to the data protection authority.
11. How long We retain Your Personal Data:
We will retain Your Personal Data only for as long as We need, We need it for Our legitimate interest in accordance with applicable law, to fulfill Your registration and application process and to perform services as You have opted for, or to meet legal requirements, after which We will take steps to delete Your Personal Data or hold it in a form that no longer identifies You.
Please note, Your Personal Data will be processed in or accessed from jurisdiction outside India by members of TechM group entities and categories of recipients (e.g., Customers or Service Providers) in jurisdiction that do not have equivalent data protection laws to those in India for the purpose outlined above. When We transfer Your data to outside TechM group, We use standard contractual clauses in compliance with the provisions of GDPR and the IT Act to safeguard the transfer, unless We transfer the data to third party, that has implemented GDPR and the IT Act, in which case, We may rely on one of those mechanisms to safeguard the transfer. 12. Security:
We take Our responsibilities to protect Your privacy very seriously. Technical safeguards, such as firewalls, antivirus software, and data encryption are used to help ensure that Your Personal Data is kept safe and only disclosed to people who are authorised to view it.
Where We are required to share Your Personal Data with third parties, We will take reasonable technical and organizational precautions to prevent the loss, misuse or alteration of Your Personal Data and We will try to ensure that We only share it in ways that are secure.
The transmission of information via the internet or email is not completely secure. Although We will do Our best to protect Your Personal Data, We cannot guarantee the security of data while You are transmitting it to Our Platform; any such transmission is at Your own risk. Once We have received Your Personal Data, We will use strict procedures and security features to try to prevent unauthorized access.
Where, We have given You (or where You have chosen) a password so that You can access certain parts of Our Platform, You are responsible for keeping this password confidential. You should choose a password, which is not easy for someone to guess.
13. Updates to this Privacy Notice:
This privacy notice may be updated periodically. We will update the date at the top of this privacy notice accordingly and encourage You to check for changes to this privacy notice, which will be available at Site.
On some occasions, We may also actively advise You of specific data handling activities or significant changes to this privacy notice, as required by the applicable law.

By accessing or using the website www.UNIVERSALIRIS.techmahindra.com (“Site”), it is deemed that You acknowledge and have accepted all the terms of use for the Site after careful perusal of them, which are applicable to all the Users of the Site (the “Terms of Use”). If You do not agree to any provisions in the Terms of Use, Privacy Policy or any other Policies referred in this Terms of Use, You should immediately close this IRIS tool/Site and not access or submit any information on this Site. The Terms of Use, Privacy Policy and any other policies incorporated by reference or issued from time to time (including any amendments, modifications or changes thereto) are considered integral part of these Terms of Use and are incorporated herein.
These Terms of Use shall regulate and govern the relationship between TechM (as defined hereinafter) and the Users (as defined hereinafter) and shall be fully binding on each of the Users.
1. The term "User" shall mean, all persons who use, access, browse the Site, having registered accounts with a user identification email and password. User shall also be referred to as “You(“Users”/ “You”/ “Your”)
2. The Term “TechM” shall mean, Tech Mahindra Limited, a company incorporated under the Companies Act, 1956, having its registered office at Gateway Building, Apollo Bunder, Mumbai - 400001, Maharashtra, India (“TechM”, which expression shall unless repugnant to the context or meaning thereof, be deemed to include all of its successors, administrators, executors and assigns);
3. The Site is owned by TechM. All content present on this Site, including all the information, logos, button icons, software and tools, TechM Software, data, software codes, interface, software, text, images, graphics, video and audio used on this Site, designs and the collection, arrangement and assembly of the content on the Site or any of the other services accessible or available through any part of the Site are is exclusive and proprietary material owned by TechM or licensed to TechM (“TechM Content”) except any content or Solutions uploaded by the TechM’s IRIS Program Partner or Contributors on the Site.
4. The IRIS name and logo are trademarks, which belong to and are owned by TechM. These trademarks may not be used by You in any manner whatsoever without prior written consent from TechM.
5. TechM authorizes, You to view and access the TechM Content, solely for ease of navigating on the Site, and therefore, TechM grants You a personal, non-exclusive, non-transferable, non-assignable, non-sub licensable, limited privilege and revocable permission to enter, access and use the Site and the services provided therein. This permission does not include a permission for making commercial use of the TechM Content.
6. If You do not agree to the terms contained in the Terms of Use, You are advised not to proceed to access, browse, or register on the Site. You shall accept the Terms of Use without any modification. The continued access, browsing and use of the Site would constitute acceptance of the terms and conditions of this Terms of Use.
7. It is agrees that any person or entity who has purchased a license of the Site (“TechM’s IRIS Program Partner”) may post their Business Issues or challenge (“Business Issues”) on the Site. TechM’s IRIS Program Partner agrees that neither TechM nor any of the Contributor shall be liable to provide any concrete or satisfactory solutions to their Business Issues. In addition, TechM’s IRIS Program Partners agrees that it shall not claim from TechM or any of the Contributors; any losses, damages, penalties, or suits, it may incur on account of Solutions provided to their Business Issues on the Site.
8. User shall have access to such Business Issues or challenges though the Site and permitted to upload/submit its ideas solutions for such Business Issues or challenges on the Site (“Solution”). The User, who submits/upload Solution on the Site shall be defined as “the Contributor”.
9. Contributor agrees that by posting any Solution, Contributor will not be eligible for any payment or consideration and Contributor will post any of such Solution on its own discretion without any commitment from TechM, TechM’s IRIS Program Partner’s or any third party.
10. Contributor agrees that the Solution the Solutions uploaded or submitted on the Site shall be Contributor’s original idea and uploaded/submitted after verifying that the such Solutions are not infringing or/and not copied from IP belonging to any other person/entity. Contributors agrees to indemnify and hold TechM and TechM’s IRIS Program Partner’s harmless for any claim, suits, penalties, damages, or claims on account of Solution uploaded/submitted by the Contributor.
11. By uploading/submitting the Solution, Contributor agrees and allows TechM and TechM’s IRIS Program Partner’s, nNon-exclusive, fully paid-up and perpetual license to use, modify, adapt, implement, commercialize, create derivatives etc. with regard to the Solutions available to TechM and TechM’s IRIS Program Partners from the Contributors.
12. Any reward program on the Site (IRIS Reward Program”), for the Solutions submitted by the COntributor will be at sole discretion of TechM and TechM shall be eligible to amend, update or modify any such program at any time.
13. TechM shall not be liable for any indirect and consequential losses, including but not limited to loss of profit, loss of revenue, loss of opportunity, loss of business, loss of goodwill or benefits; which User may incur by virtue of using the Site.
14. In case of any dispute regarding the interpretation of the IRIS Terms of Use, Privacy Policy or any other policies related to Site, TechM’s decision shall be final and binding on You.
15. By using the Site, the User agrees to follow and be bound by the following terms and conditions and these terms and conditions may be revised or modified at any time by TechM without any notice to the User:
A. No material from this Site may be copied, modified, reproduced, republished, uploaded, transmitted, posted or distributed in any form without prior written permission from TechM. All rights not expressly granted herein are reserved.
B. Users are prohibited from (i) violating or attempting to violate the integrity or security of the Site or the TechM Content. (ii) transmitting any information on or through the Site that is disruptive or competitive to the provision of Site or TechM; (iii) intentionally submitting on the Site, false or inaccurate information; (iv) attempting to decipher, decompile, disassemble or reverse engineer any part of the Site, or attempting to create any derivate works of the Site;
C. Unauthorized use of the materials appearing on this Site may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties. Tech Mahindra may monitor access to the Site.
D. TechM may terminate the User's access to the Site at any time for any reason. The provisions regarding disclaimer of warranty, accuracy of information and indemnification shall survive such termination.
E. The Site, and all content, materials, information, software, products and services provided on the Site, are provided on an "as is" and "as available" basis.
F. TechM shall have no responsibility for any damage to User's system or loss of data that result from the download of any content, materials, and information from the Site.
G. TechM may unilaterally change or discontinue any aspect of the Site at any time, including, its content or features. TechM reserves the right to refuse or to allow any content through the Site or to edit or remove any content at any time with or without notice.
H. TechM will not be liable for damages of any kind, including without limitation, direct, indirect, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) arising out of the use of or inability to use the Site, or any information provided on the Site, or for any other reason whatsoever.
I. The User agrees to indemnify, defend and hold Tech Mahindra harmless from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, arising out of or relating to any misuse by the User of the content and services provided on the Site.
J. The information contained in the Site has been obtained from sources believed to be reliable. Tech Mahindra disclaims all warranties as to the accuracy, completeness or adequacy of such information.
K. The Site provides links to web sites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the Site. The User agrees that Tech Mahindra is not responsible for the availability of, and content provided on, third party web sites. The User is requested to peruse the policies posted by other web sites regarding privacy and other topics before use. Tech Mahindra is not responsible for third party content accessible through the Site, including opinions, advice, statements and advertisements, and the User shall bear all risks associated with the use of such content. Tech Mahindra is not responsible for any loss or damage of any sort that the User may incur from dealing with any third party.
L. Tech Mahindra makes no warranty that: (a) the Site will meet your requirements; (b) the Site will be available on an uninterrupted, timely, secure, or error-free basis; (c) the results that may be obtained from the use of the Site or any services offered through the Site will be accurate or reliable.
M. Tech Mahindra, in its reasonable discretion may terminate your account and/or user login credentials, remove, and discard any content within the Site, if Tech Mahindra believes that, you have violated or acted inconsistently with the letter and spirit of these terms of service.
N. You may terminate your account, this Agreement and your right to use the Site at any time and for any reason or no reason, by contacting IRIS user support at iris@techmahindra.com
O. You are solely responsible for your interaction with other users via Site. If you have a dispute with one or more Users, the only remedy is to stop using the Site.
P. IRIS accounts will be accessed through EMAIL ID and password that you will create (your “Credentials”). Your Credentials are solely for your use and must not be shared with other Users. All Users must have their own account, User ID and Credentials. You agree that your Credentials and the information you provide upon registration and at all other times will be true, accurate, current, and complete (including your name and your company’s name). You are responsible for maintaining the confidentiality of your account password and for all the activities that occur in your account. You agree to immediately notify Tech Mahindra of any unauthorized use of your account, password, Credentials, or any other breach of security. You agree that Tech Mahindra will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.
16. For the purposes of registration and identifying a User on the Site, TechM may, from time to time, collect certain personally identifiable information processed in accordance with Privacy Policy available at the site. By registering on Site, User has given express and specific consent for such collection and processing of data for the purpose of allowing meaningful and efficient use of Site.
17. You agree to provide true, accurate and complete information as prompted by the registration form and all other forms You access on Site, and You agree to maintain and promptly update all data provided by You and to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current, incomplete, or if TechM has reasonable grounds to suspect that the information provided by You is untrue, inaccurate, not current, incomplete, or not in accordance with the terms of this Agreement, TechM reserves the right to indefinitely suspend, terminate or block Your access to Site, and refuse to provide You with access to Site in future.
18. User agrees that any information provided by User on Site is the sole responsibility of the User and TechM does not take any responsibility for protection of such information. User further agrees to indemnify TechM against claims arising in regard to such information.
19. You agree that, the TechM has approved your use of the Site on “as-is” basis, without any warranty for completeness and fitness for purpose.
20. The Site may contain links to other websites and outside services and resources, the availability and content of which is not controlled, reviewed or monitored by TechM. You agree that viewing other such websites or utilizing outside services and resources is done at Your own risk. TechM shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
21. While TechM shall make reasonable endeavors to maintain generally accepted standards of security and shall provide the Site by using reasonable efforts, TechM shall not be liable for any interruption that may be caused to Your access or use of the Site
22. THE SERVICES PROVIDED ON THE SITE BY TECHM OR ITS THIRD-PARTY SERVICE PROVIDERS ARE PROVIDED ON AN “AS IS” BASIS, AS AVAILABLE, AND WITHOUT ANY REPRESENTATIONS OR WARRANTIES OR CONDITIONS (WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE).. TECHM MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE QUALITY, IDENTITY OR RELIABILITY OF ANY THIRD PARTY, OR AS TO THE ACCURACY OF THE POSTINGS MADE ON THE WEBSITE BY ANY USER OR THIRD PARTY. FURTHER, WE MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, THAT ACCESS TO THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS UP-TO-DATE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SITE WILL BE ACCESSIBLE AT ALL TIMES.
23. In no event shall TechM or its third-party service providers be liable to You or any other User for any special, indirect, consequential, incidental or punitive damages pursuant to this Terms of Use, including but not limited to, loss of profits, loss of business opportunities or loss of goodwill, even if advised of the possibility of such damages.
